Terms and Conditions

1. Introduction and Acceptance

 1.1. Bu “Şartlar ve Koşullar” (“Hükümler”), edverd.com (“Site”) üzerinde sunulan hizmetlerin ve içeriklerin kullanımına ilişkin haklarınızı, sorumluluklarınızı ve yükümlülüklerinizi düzenler.

 1.2. Site’ye kayıt oluşturarak (“Üye”), bu Hükümler’in tamamını okumuş, anlamış ve kabul etmiş sayılırsınız. Kayıt aşamasında onay kutusunu işaretleyerek bu Hükümler’i kabul ettiğinizi beyan ve taahhüt etmiş olursunuz.

 1.3. Site yönetimi, gerekli gördüğü hallerde işbu Hükümler’i tek taraflı olarak değiştirme hakkına sahiptir. Yapılan güncellemeler, “En Son Güncelleme” tarihiyle birlikte bu sayfada ilan edilir. Üyelerin, Site’yi kullanmaya devam ederek güncellenmiş Hükümler’i kabul ettikleri varsayılır.

2. Definitions

  • Site: edverd.com internet adresi ve bağlı alt alan adları üzerinden erişilebilen tüm dijital platformları, sayfaları ve içerikleri ifade eder.

  • Üye / Kullanıcı: Site’ye kayıt oluşturarak hizmetlerden yararlanan gerçek kişiler.

  • Üyelik: Üyenin, Site’ye e-posta ve şifre belirleyerek oluşturduğu kişisel hesaptır.

  • Fiziksel Ürünler: Site üzerinden sipariş verilen, dağıtımı kargo yoluyla gerçekleştirilen fiziksel mal ve eşyayı ifade eder.

  • Dijital Abonelik: Aylık yenilenen, Site üzerinden satın alınan ve ekran tabanlı sunulan dijital premium içeriklere erişim hakkı sağlayan abonelik hizmetini ifade eder.

  • PayTR: Ürün satın alma ve abonelik ödemelerinin tamamının güvenli biçimde gerçekleştirildiği, PCI-DSS uyumlu üçüncü taraf ödeme altyapısını ifade eder.

  • Velo by Wix: Site’nin barındırıldığı, arka uç (backend) işlemlerinin yönetildiği ve kullanıcı hesaplarının kaydedildiği Wix tabanlı geliştirme altyapısını ifade eder.

  • Hükümler: İşbu “Şartlar ve Koşullar” metnini oluşturan hükümler bütününü ifade eder.

3. Scope of Terms and Changes

3.1. These Terms cover the rights and obligations regarding accessing the Site, creating a Membership, purchasing physical products and digital subscriptions, on-Site account management, live chat and the use of all other services offered on the Site.

3.2. The site administration may update, change or add additional provisions to these Terms at any time. Changes shall enter into force after being published on this page with the "Last Updated" date. Members shall be deemed to have accepted the changes as long as they continue to use the Site.

3.3. Even if any provision of the Terms is determined to be null, void or unenforceable by a court decision, the other provisions remain in full force and effect.

4. Membership and Account Management

4.1. Creating a Membership

  • Anyone who wants to purchase physical products or benefit from digital subscription services through the site is required to create a Membership.

  • During membership, you must specify your name, surname, valid e-mail address and password. The specified password is hashed and stored securely by the Velo by Wix infrastructure.

  • In addition to the membership form, address, telephone number and Turkish ID number information are requested when purchasing a subscription or product. These data are mandatory for billing and shipping processes and subscription verification.

4.2. Member Responsibilities

  • You are responsible for protecting the confidentiality of your membership information (e-mail and password). Any damages and liabilities arising from the misuse of this information belong to you.

  • Ensuring that your registered e-mail address is correct makes it easier to forget your password or during the confirmation process. You are responsible for keeping your e-mail address up to date.

  • If you notice any unauthorized access or security issue, you are responsible for immediately notifying the Site administration.

4.3. Account Cancellation and Deletion

  • Members may terminate their Membership at any time through their account settings or through the “Delete My Account” option on the Site.

  • After the account deletion request is received; your membership account, profile information on the Site, past order/subscription records are deleted. However; “Physical Product Purchase Data” and “Digital Subscription Data” are stored for 10 years within the scope of invoice and accounting requirements (due to KVKK and Tax Procedure Law). This data is kept for the inspections and audits that may be requested by UYAP and relevant tax offices; it is not shared with third parties.

5. Purchasing Physical Products

5.1. Determining the Product and Adding to the Cart

  • Members can examine the physical products listed on the Site and view the description, price, shipping fee, stock status and images on the product page.

  • You can add the product you want to buy to your shopping cart by clicking the "Add to Cart" button. You can add more than one product to your cart and make changes such as quantity and color.

5.2. Payment and Delivery Process

  • During the purchase process, address, telephone and TR ID number (for invoicing purposes) information is requested through the Membership account; this information is automatically transferred to the PayTR payment form.

  • The payment transaction is carried out completely securely via the PayTR infrastructure. Card information (card number, expiration date, CVV) is transmitted directly to PayTR servers; it is never transferred to edverd.com servers.

  • Once the payment is completed successfully, a “Successful Payment” response is received from the PayTR API; edverd.com systems perform the following actions:

  • Creating the order record and generating invoice numbers,

  • Saving invoice/address information to the Velo by Wix database for integration with the cargo company,

  • Sending an “Order Confirmation email” to the Member.

5.3. Pricing and Taxes

  • Prices stated on the Site are in Turkish Lira (₺) and include VAT. Shipping costs (if any) incurred during payment are shown separately.

  • Prices may be updated without notice due to technical glitches, typographical errors or supplier changes. The price valid at the time of payment is the price at the time the order is finalized.

5.4. Delivery and Shipping

  • After payment is confirmed, products are sent to the invoice/shipping address specified by the Member within 2–5 business days. Shipping time may vary depending on geographical location and density.

  • edverd.com is not responsible for delays caused by the cargo company; however, the cargo tracking number is provided to the Member for cargo tracking.

  • In case of damage or loss during shipping, the Member must contact the cargo company directly. edverd.com will communicate the necessary procedure to the Member to assist in the return and exchange process.

5.5. Returns, Exchanges and Refunds

  • Fiziksel ürünlerde, kargo alındıktan itibaren 14 gün içinde, ürün yıpranmamış ve orijinal ambalajında olmak şartıyla iade veya değişim talebi yapılabilir. İade talebi için aşağıdaki koşulların sağlanması zorunludur:

  • The User must fill out the “Refund Request Form” from his/her Site account and submit his/her request.

  • The product must be sent back to the return address with its invoice and all accessories.

  • When the product is accepted for return, after the necessary checks are made; the refund amount is refunded to the IBAN specified in the Member's request via the bank account where the payment was made or the PayTR account within 10 business days.

  • Shipping costs are covered by edverd.com for returns/exchanges not caused by Member error; Member will only receive a refund of the product price.

  • If the product is damaged to the point that it cannot be used, edverd.com has the right to reject the return request. In rejected return requests, the product is sent back to the Member free of charge.

6. Digital Subscription Services

6.1. Subscription Plans and Content Scope

  • edverd.com offers monthly renewed digital subscription plans. Subscribers gain access to premium content on the Site (video tutorials, e-books, interactive tests, etc.) for the duration of the subscription. These contents are exclusive to active subscribers only; they can be viewed by logging in through the Membership account.

6.2. Subscription Purchase and Consent

  • The subscription process begins by clicking the "Subscribe" button on the Membership account. In the subscription form; name, surname, e-mail, telephone, address and TR ID number information is collected.

  • This information is directed to PayTR and “card information” is entered in the payment form. When the payment is completed, a “Successful Payment” response is received from the PayTR API; edverd.com systems perform the following:

  • Activates the subscription and sends a “Subscription Successful” email to the Member.

  • It records the subscription start date and the last payment date, which will be valid until the next payment, on the account.

  • The user can view the subscription start and end dates from the Account → “Subscription Management” section.

6.3. Subscription Renewal and Cancellation

  • The subscription is automatically renewed on the same day every month from the date of purchase via PayTR. For example, a monthly subscription starting on June 10, 2025 will continue on July 10, 2025, August 10, 2025.

  • Automatic renewal is performed by withdrawing the order amount using the card information defined in PayTR records.

  • The Member may stop automatic renewal at any time by clicking on the "Subscription Management" → "Cancel My Subscription" button. When a cancellation is made, the next month's fee will not be charged.

  • The cancellation request will be reflected in the next period; the amount paid in the current period will not be refunded and the Member will continue to benefit from the service as long as his/her subscription is valid.

6.4. Return Policy

  • There is no right of refund for digital subscriptions “once the use has started” or “once the content has been accessed” because the Service is offered for immediate access as digital content and can be copied.

  • If a subscription is subject to a refund request by 23:59 of the last day the subscription is valid, the subscription fee will be refunded. Refund requests exceeding this period will not be accepted.

  • Refund requests are evaluated via the Member's "Subscription Management" section or via e-mail sent to info@edverd.com. When the refund process is completed positively, the refund amount is deposited into the Member's PayTR account or bank IBAN information within 10 business days.

7. Payment, Billing and Pricing

7.1. Payment Infrastructure and Security

  • All payments made via edverd.com are made using the PayTR infrastructure. PayTR ensures data security and PCI-DSS compliance, ensuring that payment card information is processed and stored directly on its own servers. Card information is not transferred to edverd.com servers under any circumstances.

7.2. Fatura Düzenleme ve Saklama

  • For physical product purchases and digital subscription services, an e-invoice or paper invoice is issued via the Velo by Wix infrastructure using the name, surname, address and TR ID number information provided by the Member.

  • The invoice cut-off date is the order confirmation or subscription start date. The invoice number and VAT information are also included in the invoice.

  • Invoice and accounting records are stored for at least 10 years as required by the Tax Procedure Law and the Electronic Commerce Law. edverd.com does not share this data with third parties; it only provides it upon request by legal authorities or tax audits.

7.3. Discounts, Campaigns and Coupons

  • The site may publish periodic campaigns, discount coupons or promotional codes.

  • Discounts and campaigns are only valid for Members who comply with the relevant campaign conditions; the products/subscriptions and periods for which the code is valid are clearly stated in the campaign description.

  • The campaign code can only be used once and cannot be returned as cash.

8. Membership and Product/Subscription Usage Rules

8.1. Account Security and Password Sharing

  • The Member is responsible for maintaining the confidentiality of the e-mail address and password registered on the Site. Membership information cannot be shared or transferred with others.

  • The Member is responsible for any damages that may arise if the password is shared with third parties. If you notice that the password is being misused, you must immediately notify the Site administration.

8.2. Digital Content Terms of Use

  • The content offered within the scope of digital subscription (video, e-book, test, etc.) is under copyright protection. Any copying, distribution, reproduction or sharing with third parties is prohibited.

  • These contents are for personal use only and may not be used for commercial purposes. Otherwise, the legal and criminal liability arising from copyright violations belongs to the Member.

8.3. Use of Live Chat

  • Users can reach customer service via the live chat service (Wix Chat or Tawk.to) offered on the Site.

  • It is forbidden to use profanity, insults, discriminatory language or expressions that prevent the operation of the systems during the chat. In case such a situation is detected, the Site administration has the right to end the chat, restrict the user account or permanently suspend it.

8.4. Sharing of Opinions and Comments

  • If there is a blog, forum or comment section on the Site, the shared content (comments, suggestions, feedback) must not be contrary to law, morality or personal rights. Content that is illegal, may cause copyright infringement or targets third parties will be deleted; legal action will be taken when necessary.

9. Disclaimers and Limitations

9.1. Service Access and Continuity

  • edverd.com does not guarantee the uninterrupted and error-free operation of the Site. The Site service may be temporarily interrupted partially or completely due to technical reasons or maintenance work.

  • The site does not accept liability for any losses or damages that may arise due to issues such as technical problems of the infrastructure provider Wix, service interruptions of PayTR or disruptions of cargo companies.

9.2. Content Accuracy

  • Although we try to keep the product information, price, stock status, features and descriptions of digital content on the Site up to date, edverd.com cannot be held responsible for any errors or incorrect information that may occur due to lack of updating.

  • Images, color and model differences, additional components or accessories in the product introduction may not be included in the product price. It is strongly recommended that you carefully review the details and technical specifications in the product descriptions.

9.3. Damages and Compensation

  • The Member is obliged to compensate for any damages that may occur to edverd.com or third parties as a result of acting contrary to these Terms.

  • The Site is not directly responsible for damages caused by the Member to third parties; however, it reserves the right to take action in case a violation of the relevant Terms is detected.

10. Intellectual Property Rights

10.1. All texts, images, logos, videos, graphics, codes, interface designs and other contents on the Site are protected by the TCC, the Law on Intellectual and Artistic Works, copyrights and other relevant legislation.

10.2. Members may only view the Site content for personal use; they may not copy, distribute, reproduce for commercial purposes or transfer to third parties, in whole or in part. Otherwise, legal and criminal liability may arise due to copyright infringement.

11. Reference to Privacy and Cookie Policies

11.1. When you complete the steps of your membership, purchasing physical products or starting a digital subscription, you are deemed to have read and accepted the Privacy Policy and Cookie Policy.

11.2. For detailed information on how your personal data is collected, processed and stored, you can refer to the Privacy Policy; and for information on the purposes for which cookies are used and how to manage them, you can refer to the Cookie Policy.

12. Legal Validity, Applicable Law and Jurisdiction

12.1. These Terms are subject to the laws of the Republic of Türkiye.

12.2. Istanbul (Çağlayan) Courts and Enforcement Offices have jurisdiction over any disputes that may arise from the Terms.

12.3. The parties accept and undertake that they will be subject to these Terms and the legislation of the Republic of Türkiye in all disputes that may arise.
